Mengingat :

Undang-Undang Nomor 10 Tahun 1995 tentang Kepabeanan (Lembaran Negara Republik Indonesia Tahun 1995 Nomor 73, Tambahan Lembaran Negara Republik Indonesia Nomor 3612) sebagaimana telah diubah dengan Undang-Undang Nomor 17 Tahun 2006 tentang Perubahan Atas Undang-Undang Nomor 10 Tahun 1995 tentang Kepabeanan (Lembaran Negara Republik Indonesia Tahun 2006 Nomor 93, Tambahan Lembaran Negara Republik Indonesia Nomor 4661); 
Peraturan Pemerintah Nomor 28 Tahun 2008 tentang Pengenaan Sanksi Administrasi Berupa Denda di Bidang Kepabeanan (Lembaran Negara Republik Indonesia Tahun 2008 Nomor 53, Tambahan Lembaran Negara Republik Indonesia Nomor 4838) sebagaimana telah diubah dengan Peraturan Pemerintah Nomor 39 Tahun 2019 tentang Perubahan Atas Peraturan Pemerintah Nomor 28 Tahun 2008 tentang Pengenaan Sanksi Administrasi Berupa Denda di Bidang Kepabeanan (Lembaran Negara Republik Indonesia Tahun 2019 Nomor 100, Tambahan Lembaran Negara Republik Indonesia Nomor 6352);

MEMUTUSKAN :

Menetapkan :

PERATURAN MENTERI KEUANGAN TENTANG TATA CARA PENGHITUNGAN SANKSI ADMINISTRASI BERUPA DENDA DI BIDANG KEPABEANAN.

Pasal 1

Dalam Peraturan Menteri ini yang dimaksud dengan:
Barang Impor adalah barang yang dimasukan ke dalam daerah pabean dari luar daerah pabean.
Kantor Pabean adalah kantor dalam lingkungan Direktorat Jenderal Bea dan Cukai tempat dipenuhinya kewajiban pabean sesuai dengan ketentuan Undang-Undang Kepabeanan.
Importir adalah orang perseorangan atau badan hukum yang melakukan kegiatan impor.
Nilai Pabean adalah nilai yang digunakan sebagai dasar untuk penghitungan bea masuk dan pungutan dalam rangka impor lainnya.
Menteri adalah Menteri Keuangan Republik Indoneisa.
Pejabat Bea dan Cukai adalah Direktur Jenderal Bea dan Cukai atau pegawai Direktorat Jenderal Bea dan Cukai yang ditunjuk dalam jabatan tertentu untuk melaksanakan tugas tertentu berdasarkan Undang-Undang Kepabeanan.

Pasal 2

(1) Sanksi administrasi berupa denda dikenakan hanya terhadap pelanggaran yang diatur dalam Undang-Undang Kepabeanan.
(2) Sanksi administrasi berupa denda sebagaimana dimaksud pada ayat (1), besarnya dinyatakan dalam:
nilai rupiah tertentu;
nilai rupiah minimum sampai dengan maksimum;
persentase tertentu dari bea masuk yang seharusnya dibayar;
persentase tertentu minimum sampai dengan maksimum dari kekurangan pembayaran bea masuk atau bea keluar; atau
persentase tertentu minimum sampai dengan maksimum dari bea masuk yang seharusnya dibayar.

Pasal 3

(1) Besarnya denda yang dinyatakan dalam nilai rupiah tertentu sebagaimana dimaksud dalam Pasal 2 ayat (2) huruf a, dilaksanakan sesuai dengan Undang-Undang Kepabeanan.
(2) Ketentuan sebagaimana dimaksud pada ayat (1), berlaku untuk Pasal 10A ayat (8), Pasal 11A ayat (6), Pasal 45 ayat (3), Pasal 52 ayat (1) dan ayat (2), Pasal 81 ayat (3), Pasal 82 ayat (3) huruf b, Pasal 86 ayat (2), Pasal 89 ayat (4), Pasal 90 ayat (4), dan Pasal 91 ayat (4) Undang-Undang Kepabeanan.

Pasal 4

(1) Besarnya denda yang dinyatakan dalam nilai rupiah minimum sampai dengan maksimum sebagaimana dimaksud dalam Pasal 2 ayat (2) huruf b, ditetapkan secara berjenjang dengan ketentuan apabila dalam 6 (enam) bulan terakhir terjadi:
1 (satu) kali pelanggaran, dikenakan denda sebesar 1 (satu) kali denda minimum;
2 (dua) kali pelanggaran, dikenakan denda sebesar 2 (dua) kali denda minimum;
3 (tiga) sampai dengan 4 (empat) kali pelanggaran, dikenakan denda sebesar 5 (lima) kali denda minimum;
5 (lima) sampai 6 (enam) kali pelanggaran, dikenakan denda sebesar 7 (tujuh) kali denda minimum; dan
lebih dari 6 (enam) kali pelanggaran, dikenakan denda sebesar 1 (satu) kali denda maksimum.
(2) Ketentuan sebagaimana dimaksud pada ayat (1), berlaku untuk Pasal 7A ayat (7), Pasal 7A ayat (8), Pasal 8A ayat (2) dan ayat (3), Pasal 8C ayat (3) dan ayat (4), Pasal 9A ayat (3), dan Pasal 10A ayat (3) dan ayat (4) Undang-Undang Kepabeanan.
(3) Sanksi administrasi berupa denda sebagaimana dimaksud pada ayat (1), dikenakan terhadap masing-masing pelanggaran atas ketentuan sebagaimana dimaksud pada ayat (2) pada 1 (satu) Kantor Pabean.
(4) Dalam hal pada 1 (satu) kegiatan kepabeanan terjadi beberapa pelanggaran, Pejabat Bea dan Cukai menerbitkan penetapan mengenai pengenaan sanksi administrasi berupa denda terhadap setiap pelanggaran.
(5) Sanksi administrasi berupa denda sebagaimana dimaksud pada ayat (1) dan ayat (3), dikenakan terhadap pengangkut sesuai dengan ketentuan peraturan perundang-undangan mengenai penyerahan rencana kedatangan sarana pengangkut, manifes kedatangan sarana pengangkut, dan manifes keberangkatan sarana pengangkut.
(6) Tata cara penghitungan besaran denda yang dinyatakan dalam nilai rupiah minimum sampai dengan maksimum sebagaimana dimaksud pada ayat (1), dilaksanakan sesuai dengan simulasi yang tercantum dalam Lampiran huruf A yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Pasal 5

(1) Besarnya denda yang dinyatakan dalam persentase tertentu dari bea masuk yang seharusnya dibayar sebagaimana dimaksud dalam Pasal 2 ayat (2) huruf c, diperoleh dari hasil perkalian persentase tertentu dengan bea masuk yang seharusnya dibayar.
(2) Ketentuan sebagaimana dimaksud pada ayat (1), berlaku untuk Pasal 10B ayat (6), Pasal 10D ayat (5) dan ayat (6), Pasal 43 ayat (3), dan Pasal 45 ayat (4) Undang-Undang Kepabeanan.
(3) Tata cara penghitungan besaran denda yang dinyatakan dalam persentase tertentu dari bea masuk yang seharusnya dibayar sebagaimana dimaksud pada ayat (1), dilaksanakan sesuai dengan simulasi yang tercantum dalam Lampiran huruf B yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Pasal 6

(1) Besarnya denda yang dinyatakan dalam persentase tertentu minimum sampai dengan maksimum dari kekurangan pembayaran bea masuk atau bea keluar sebagaimana dimaksud dalam Pasal 2 ayat (2) huruf d, ditetapkan secara berjenjang berdasarkan perbandingan antara total kekurangan pembayaran bea masuk atau bea keluar yang terkena denda dengan total pembayaran bea masuk atau bea keluar yang telah dibayar dari seluruh Barang Impor atau barang ekspor yang dikenakan denda dalam satu pemberitahuan pabean, dengan ketentuan apabila total kekurangan pembayaran bea masuk atau bea keluar yang terkena denda:
sampai dengan 50% (lima puluh persen) dari total bea masuk atau bea keluar yang telah dibayar yang dikenakan denda, dikenakan denda sebesar 100% (seratus persen) dari total kekurangan pembayaran bea masuk atau bea keluar yang terkena denda; 
di atas 50% (lima puluh persen) sampai dengan 100% (seratus persen) dari total bea masuk atau bea keluar yang telah dibayar yang dikenakan denda, dikenakan denda sebesar 125% (seratus dua puluh lima persen) dari total kekurangan pembayaran bea masuk atau bea keluar yang terkena denda;

(3) Penghitungan bea masuk atau bea keluar yang seharusnya dibayar karena kesalahan yang dikenakan denda sebagaimana dimaksud pada ayat (1), menggunakan pembebanan bea masuk atau bea keluar sesuai dengan pembebanan hasil penetapan Pejabat Bea dan Cukai.

Pasal 7

Dalam hal pada pemberitahuan pabean terdapat:
kesalahan pembebanan yang mengakibatkan kekurangan pembayaran bea masuk atau bea keluar, terhadap kesalahan pembebanan tersebut tidak dikenakan sanksi administrasi berupa denda;
kesalahan Nilai Pabean yang mengakibatkan kekurangan pembayaran bea masuk atau bea keluar, terhadap kesalahan Nilai Pabean tersebut dikenakan sanksi administrasi berupa denda;
kesalahan pembebanan yang mengakibatkan kekurangan pembayaran bea masuk atau bea keluar yang disertai dengan kesalahan Nilai Pabean, terhadap kesalahan tersebut dikenakan sanksi administrasi berupa denda;
kesalahan pembebanan tambahan bea masuk sesuai dengan Undang-Undang Kepabeanan yang disertai dengan kesalahan Nilai Pabean, terhadap kesalahan tersebut dikenakan sanksi administrasi berupa denda;
kesalahan Nilai Pabean yang mengakibatkan kelebihan pembayaran bea masuk, terhadap kesalahan tersebut tidak dikenakan sanksi administrasi berupa denda; atau
kesalahan Nilai Pabean yang mengakibatkan kekurangan pembayaran bea masuk disebabkan Nilai Pabean hasil penetapan Pejabat Bea dan Cukai lebih rendah dari Nilai Pabean pada pemberitahuan pabean dan pembebanan hasil penetapan Pejabat Bea dan Cukai lebih tinggi dari pada pembebanan pada pemberitahuan pabean, terhadap kesalahan tersebut tidak dikenakan sanksi administrasi berupa denda.

Pasal 8

Tata cara penghitungan besaran denda sebagaimana dimaksud dalam Pasal 6 dan Pasal 7, dilaksanakan sesuai dengan simulasi yang tercantum dalam Lampiran huruf C yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Pasal 9

(1) Besarnya denda yang dinyatakan dalam persentase minimum sampai dengan maksimum dari bea masuk yang seharusnya dibayar sebagaimana dimaksud dalam Pasal 2 ayat (2) huruf e, ditetapkan secara berjenjang berdasarkan perbandingan antara bea masuk atas fasilitas yang disalahgunakan dengan total bea masuk yang mendapat fasilitas, dengan ketentuan apabila kekurangan pembayaran bea masuk:
sampai dengan 20% (dua puluh persen), dikenakan denda sebesar 100% (seratus persen) dari bea masuk yang seharusnya dibayar;
di atas 20% (dua puluh persen) sampai dengan 40% (empat puluh persen), dikenakan denda sebesar 200% (dua ratus persen) dari bea masuk yang seharusnya dibayar;
di atas 40% (empat puluh persen) sampai dengan 60% (enam puluh persen), dikenakan denda sebesar 300% (tiga ratus persen) dari bea masuk yang seharusnya dibayar;
di atas 60% (enam puluh persen) sampai dengan 80% (delapan puluh persen), dikenakan denda sebesar 400% (empat ratus persen) dari bea masuk yang seharusnya dibayar; atau
di atas 80% (delapan puluh persen) sampai dengan 100% (seratus persen), dikenakan denda sebesar 500% (lima ratus persen) dari bea masuk yang seharusnya dibayar.
(2) Ketentuan sebagaimana dimaksud pada ayat (1) berlaku untuk Pasal 25 ayat (4) dan Pasal 26 ayat (4) Undang-Undang Kepabeanan.
(3) Tata cara penghitungan besaran denda yang dinyatakan dalam persentase minimum sampai dengan maksimum dari bea masuk yang seharusnya dibayar sebagaimana dimaksud pada ayat (1), dilaksanakan sesuai dengan simulasi yang tercantum dalam Lampiran huruf D yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Pasal 10

(1) Terhadap pelanggaran yang dikenakan sanksi administrasi berupa denda yang dihitung berdasarkan persentase dari bea masuk untuk Barang Impor yang tarif atau tarif akhir bea masuknya yang berkaitan dengan pelanggaran besarnya 0% (nol persen), dikenakan sanksi administrasi berupa denda sebesar Rp5.000.000,00 (lima juta rupiah).
(2) Tata cara penghitungan besaran denda terhadap pelanggaran sebagaimana dimaksud pada ayat (1), dilaksanakan sesuai dengan simulasi yang tercantum dalam Lampiran huruf E yang merupakan bagian tidak terpisahkan dari Peraturan Menteri ini.

Pasal 11

Peraturan Menteri ini mulai berlaku pada tanggal 15 Juli 2019.

Agar setiap orang mengetahuinya, memerintahkan pengundangan Peraturan Menteri ini dengan penempatannya dalam Berita Negara Republik Indonesia.
